AN ACT to add a new section to Article 87 of the Annotated
Code of Maryland (1939 Edition), title "Sheriffs", sub-title
"Custody of Prisoners", said new section to be known as
Section 46A and to follow immediately after Section 46 of
said Article, providing that in chartered counties, the
duties of the Sheriff in connection with the keeping of
prisoners, while in the County jail, may be exercised by a
jailer or warden.
WHEREAS, during the past year in Montgomery County
there have been two successful jail breaks, one attempted jail
break, and one instance of assault upon the warden by a
prisoner; and
WHEREAS, the Federal Bureau of Prisons has conducted an
investigation and has made certain recommendations to pre-
vent any recurrence of such violence; and
WHEREAS, the Maryland State Prison Inspector, in his last
two annual reports, has recommended that the administration
of the County Jail and the custody of the prisoners therein
be placed under the control of the County Government, and
WHEREAS, it is essential that these recommendations be im-
mediately placed in effect; now therefore
SECTION 1. Be it enacted by the (General Assembly of Mary-
land, That a new section be and it is hereby added to Article
87 of the Annotated Code of Maryland (1939 Edition), title
"Sheriffs", sub-title "Custody of Prisoners", said new section
to be known as Section 46A and to follow immediately after
Section 46 of said Article and to read as follows:
46A. Where any County has adopted a Charter under
Article XIA of the Constitution of Maryland, the County
Council of such County may by resolution, ordinance or local
law provide for the appointment of a qualified person to act
as jailer or warden of the County Jail, together with such
qualified assistants as inay be necessary to perform the
duties of such office. Any jailer or warden appointed pur-
