PERSON, OR TO ANY PERSON WHO, AT THE TIME
OF SUCH SALE, OR DELIVERY, IS VISIBLY UNDER
THE INFLUENCE OF ANY ALCOHOLIC BEVERAGE.
IT IS HEREBY EXPRESSED TO BE THE LEGISLATIVE
INTENT THAT THE PROVISIONS OF SUB-SECTION
(A) OF SECTION 103 SHALL NOT APPLY TO ALLE-
GANY, FREDERICK, CARROLL, CECIL, HARFORD,
SOMERSET, TALBOT, WICOMICO AND WORCESTER
COUNTIES AND THE LAW IN THESE ABOVEMEN-
TIONED COUNTIES SHALL REMAIN IN THE SAME
FORCE AND EFFECT AS IF NOT AMENDED BY THIS
ACT.
(c) In Montgomery County it shall be unlawful for any
person to sell or to give to minors any alcoholic beverages or
to keep ingredients, materials or instrumentalities with in-
tent to manufacture alcoholic beverages for sale or gift to
minors. Any person violating any of the provisions of this
sub-section shall be guilty of a misdemeanor and, upon con-
viction thereofy shall suffer the penalties provides "by Section
170 of this Article.
(d) It shall be unlawful for any minor under twenty-one
years of age, either for his own use or for the use of any other
person, to represent his age to be twenty-one years or over for
the purpose of purchasing, receiving or obtaining any alco-
holic beverages. Any person violating any of the provisions
of this sub-section shall be guilty of a misdemeanor and upon
conviction thereof, shall be fined not less than $10 nor more
than $20 or imprisoned for not less than five days nor more
than twenty days, or both, in the discretion of the Court.
(e) It shall "be unlawful for any person not a minor under
twenty-one years of age to represent the age of any minor
under twenty-one years of age to be twenty-one years or over
for the purpose of aiding, assisting or abetting such minor
to purchase, receive or obtain any alcoholic beverages. Any
person violating any of the provisions of this sub-section shall
be guilty of a misdemeanor and, upon conviction thereof, shall
suffer the penalties prescribed in Section 170 of this Article.
SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1950.
