996 LAWS OF MARYLAND. [CH. 708

Any person convicted before any Justice of the Peace or
Court of Justice of this State for violating any of the pro-
visions of this*-* Section shall be fined not less than Twenty-
Five Dollars ($25. 00) nor more than One Hundred Dollars
(f 100. 00) and costs for each and every offense and in addition
to said fine shall be fined Five Dollars ($5. 00) for each and
every migratory bird caught or killed by him illegally on said
area.

BEAVER, MUSKRAT AND OTTER.

64. No person may hunt any muskrat or otter or have the
meat or pelt of any muskrat or otter in his possession whether
same are trapped, caught, or killed within the State of Mary-
land or any other State, territory, or country, except between
January 1 and March 15 inclusive, provided, however, that any
person may have green muskrat or otter skins in his possession
until March 25 for purposes of curing such skins.

(a) Nothing herein contained shall prohibit the possession
of dried and cured muskrat or otter skins for business pur-
poses. Provided, however, it shall be lawful to have the meat
of the muskrat or otter in possession not more than three (3)
days after the close of the legal hunting season for the purpose
of disposing of the meat or meats for food.

(b) No person may shoot at, or gig, or kill, or catch any
muskrat or otter in any manner except by trapping, and no
person shall dig into or in any manner molest or destroy any
part of a muskrat or otter den or house. No person may
possess at any time the hide or skin of any muskrat or otter
which has been caught in any way except by trapping, and any
muskrat or otter hide or skin which has been punctured by a
hole which appears to be a shot or bullet hole shall be prima
facie evidence that the muskrat or otter was illegally killed.

No person shall possess at any time a light for the purpose
of hunting muskrats or otter at night time. Possession of such
a light shall be prima facie evidence that it was intended for
such purpose.

A landowner or his lessee shall have the exclusive right to
trap for muskrats down to the mean low water mark on marsh
land adjacent to his land. No person shall enter upon or place
traps upon any such land without first obtaining the written
consent of the landowner or his lessee. It shall be unlawful to
hunt, pursue, or kill any beaver at any time.
