that purpose, provided application is made before December 1,
1943. The additional licensees and those already licensed to
fish in 1943 shall not exceed the total number of such licenses
issued in 1942. The first license to be issued shall be to those
who have applied since November 1, 1941, but who have not
been granted a license. If the number of qualified applicants
is less than the difference between the 1942 and 1943 licenses
issued, the Commission shall issue licenses in the order that
applications are received up to but not exceeding the total
number of such licenses issued in 1942. In no case shall a
license be issued unless the applicant can show that he will
use the licensed nets within a reasonable time after issuance
of said license. The applicant shall not be licensed to fish a
greater number of nets than he actually fished during the last
year in which he engaged in the taking of fish for commercial
purposes. In no case shall the number of licensed nets to any
licensee exceed the average number of nets or the average
length of nets for which licenses were issued in 1942 in the
particular class for which application is made for such license.

63. Licenses to operate nets granted under the authority of
this sub-title shall expire on December 31st of each year, but
shall be renewable annually to the person named therein, unless
revoked or suspended for cause, provided application for re-
newal for the ensuing year be filed on or before December 1st
of the preceding year. If any person shall fail to make a bona
fide use of his license during any two consecutive license years,
the license shall lapse and shall not be renewed. Provided,
however, that no license shall lapse if the licensee fails to renew
or make bona fide use of his license because of induction or
enlistment into the armed forces or employment in essential
war industries and such licensee makes application to the
Commission for the renewal of his license within one year of
the termination of hostilities or from the date of his release
from the armed forces; and provided, further, that if a licensee
shall, at any time during the war emergency, be unable to
fish all the nets for which he was licensed because of some
condition arising out of the war, he shall not, in consequence
thereof, be deprived of his right to license such nets thereafter.

SEC. 2. And be it. further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and,
having been passed by a yea and nay vote, supported by three-
fifths of all of the members elected to each of the two Houses
of the General Assembly, the same shall take effect from the
date of its passage.
