CHAPTER 521.
(House Bill 418)
AN ACT to add one new section to Chapter 200 of the Acts
of 1931, incorporating the town of Cheverly, said section to
be known as Section 8-A, to follow immediately after Section
8 of said Chapter, authorizing the Mayor and Town Council
of Cheverly to levy and collect a special assessment and to
pass ordinances to provide for a trash and garbage collection
and disposal service, and providing for the submission of
this Act to the vote of the residents of Cheverly under cer-
tain circumstances for adoption or rejection.
SECTION 1. Be it enacted by the General Assembly of Mary-
land,, That a new section be and it is hereby added to Chapter
200 of the Acts of 1931, incorp6rating the town of Cheverly,
said section to be known as Section 8A, to follow immediately
after Section 8 of said Chapter, and to read as> follows:
8A. The Mayor and Town Council of Cheverly, a municipal
corporation, is hereby authorized and empowered to levy and
collect annually a special assessment of not to exceed twenty
cents on each one hundred dollars of the assessed valuation of
all real property in the town, appearing on the books of the
town treasurer; the money derived from such special assess-
ment to be used exclusively for the establishment and mainte-
nance of a garbage and/or trash collection and disposal service
within the corporate limits of said town, said garbage and/or
ash and/or trash collection and disposal service to be estab-
lished and maintained by said Mayor and Town Council of
Cheverly, Maryland, either as a municipal operation or by
contract with such person, firm or corporation as may be
satisfactory to the said Mayor and Town Council of Cheverly
and the said Mayor and Town Council of Cheverly, Maryland,
are hereby authorized and empowered to pass such ordinances
which they may deem necessary from time to time in order
to provide for the proper collection and disposal of said gar-
bage, ashes and trash and to prescribe such penalties for the
violation thereof as they may now prescribe for the violation
of town ordinances under the authority heretofore granted.
Under no circumstances shall the tax authorized in this
section be levied, or the purposes of this section made operative
until and unless in the sole discretion of the Mayor and Town
Council of Cheverly such action is deemed expedient and neces-
sary by the Mayor and Town Council of Cheverly.
SEC. 2. The powers granted to the said Mayor and Town
Council of Cheverly under Section 1 of this Act shall not be-
