CHAPTER 520.
(House Bill 411)
AN ACT to authorize the Washington Suburban Sanitary
Commission to regulate the construction of underground or
overhead public utilities, to fix a charge for a permit, and
to relieve the Commission from supervision and payment of
inspection fees under the State Forestry Act.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Washington Suburban Sanitary Commission, in
addition to the authority over the construction and location of
underground construction within the Sanitary District, shall
have the authority to regulate the construction of any over-
head lines, poles, or other public utilities construction within
said District, along any State or County road, or street or
alley, within said District, and no person, corporation, or firm
shall erect any pole or other structure for the purpose of carry-
ing wires overhead without first having obtained a permit
from said Commission. Said Commission may require the
filing of plans with it of such location or construction, and may
charge a reasonable fee for such permit. Any violation of the
provisions of this section shall be a misdemeanor, punishable
under Section 21 of Chapter 122 of the Acts of 1918, codified as
Section 1011 of Article 16 of the Public Local Laws of
Maryland.
SEC. 2. And be it further enacted, That the Washington
Suburban Sanitary Commission is hereby given authority to
make a reasonable charge f or a permit and for such engineering
services as it is required to perform under the provision of
Section 20 of Chapter 122 of the Acts of 1918, codified as
Section 1010, Article 17, of the Public Local Laws of Maryland
(Flack Edition of 1930).
SEC. 3. And be it further enacted, That Washington
Suburban Sanitary Commission is hereby exempted from the
payment of any fees or charges under the State Forestry Act,
Sections 22 and 23 of Article 39A of the Code of Public General
Laws of Maryland.
SEC. 4. And be it further enacted, That this Act shall take
effect June 1, 1943.
