authorizing the Board of Managers of the hospital to sell
and convey unproductive lands and purchase other lands.

WHEREAS, the provisions of this section are probably invalid
and, furthermore, the power to sell and purchase property for
the State properly belongs to the Board of Public Works;
therefore

SECTION 1. Be it enacted by tine General Assembly of Mary-
land, That Section 11 of Article 44 of the Annotated Code of
Maryland (1939 Edition), title "Hospitals—Maryland", sub-
title "Springfield State Hospital", be and it is hereby repealed.

SEC. 2. And l)e it further enacted, That this Act shall take
effect June 1, 1943.

Approved March 2, 1943.

CHAPTER 48.
(House Bill 41)

AN ACT to repeal and re-enact, with amendments, Section 41
of Article 59 of the Annotated Code of Maryland (1939
Edition), title "Lunatics and Insane", sub-title "Board of
Mental Hygiene", requiring every institution having custody
of insane persons, for compensation, to have physician in
regular attendance.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 41 of Article 59 of the Annotated Code of
Maryland (1939 Edition), title "Lunatics and Insane", sub-
title "Board of Mental Hygiene", be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

41. No institution for the custody, confinement or treat-
ment of the insane, whether public, corporate or private, shall
be authorized to hold in confinement or custody any insane
person for compensation, unless there shall be a physician in
regular attendance upon such institution or house.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1943.
