dairy foods in order to assure an adequate supply and effective
distribution of dairy products to meet war and essential
civilian needs; therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
43 of the Annotated Code of Maryland (1939 Edition), title
"Health", sub-title "Adulteration of Food and Drink", said
new section to be known as Section 194A, to follow immedi-
ately after Section 194 of said Article, and to read as follows:

194A. Notwithstanding any provisions to the contrary in
Section 194 of this Article, the standards for milk fat and milk
solids contents of ice cream, frozen custard and iced milk for
the present war emergency, and six months after the cessation
of hostilities, shall be as follows:

(a) Ice cream shall contain not less than ten per centum
by weight of milk fat, and not less than eighteen per centum by
a weight of total milk solids; except when fruit, nuts, cocoa,,
chocolate, maple syrup, cakes or confection are used for the
purpose of flavoring, then it shall contain not less than eight
per centum by weight of milk fat and not less than eighteen
per centum by weight of total milk solids, except for such re-
duction in milk fat and total milk solids, as is due to the addi-
tion of such flavoring, but in no such case shall it contain less
than seven per centum by weight of milk fat nor less than fif-
teen per centum by weight of total milk solids.

(b) Frozen custard shall contain not less than ten per
centum by weight of milk fat and not less than eighteen per
centum by weight of total milk solids.

(e) Iced milk shall contain not less than three per centum
and not more than ten per centum by weight of milk fat and
not less than fourteen per centum by weight of total milk
solids.

(d) For the present war emergency, and six months after
the cessation of hostilities, the power is vested in the State
Board of Health to change, from time to time, the standards for
milk fat and milk solids contents of ice cream, frozen custard
and iced milk, provided such changes so made shall not exceed
the standards for milk-fat and milk solids contents of ice
cream, frozen custard and iced milk hereinbefore prescribed
in Sub-sections (a) to (e) of this Section 194A.

SEC. 2. And l)e it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and
