and terms of sale of said bonds, without the necessity of
submitting the same to a referendum of the qualified voters
of the County, or any subdivision thereof; prescribing the
maturities of said bonds; authorizing the payment of the
net proceeds of the sale of said bonds to the Treasurer of
the Kensington Volunteer Fire Department, Incorporated
and the expenditure of said fund by him subject to certain
limitations and conditions, for the purposes aforesaid;
authorizing and empowering the County Commissioners of
Montgomery County to levy unlimited ad valorem taxes
upon all assessable property within the corporate limits of
Montgomery County to pay the principal and interest of
said bonds to the extent that, in any year, the taxes pri-
marily charged with said payment are inadequate for said
purpose; exempting said bonds from state, county and
municipal taxation of every kind and nature whatsoever in
the State of Maryland.

WHEREAS,, that portion of the area described in Section 586
of the Code of Public Local Laws of Montgomery County
(1939 Edition) lying within the Thirteenth (13th) Election
District of Montgomery County has, for many years, received
fire protection from the Kensington Volunteer Fire Depart-
ment, Incorporated, and in recent years the urban and subur-
ban population of said area has substantially increased, neces-
sitating the expansion of the facilities, equipment and appa-
ratus of the Kensington Volunteer Fire Department, Incor-
porated and the enlargement of its operation; and

WHEREAS,, the Board of County Commissioners of Mont-
gomery County has found that said Kensington Volunteer Fire
Department, Incorporated is inadequately housed and
equipped to meet the present and future demands for fire pro-
tection in said area and has, therefore, concluded that the
County Commissioners of Montgomery County should borrow
money for the purposes of enabling said Kensington Volunteer
Fire Department, Incorporated to erect and equip a separate
Fire Department building and to procure adequate equipment
and apparatus, whenever the Fire Board, created by Section
587 of the Code of Public Local Laws of Montgomery County
(1939 Edition), certifies to the County Commissioners of
Montgomery County that such construction and acquisition
is both feasible and necessary; and

WHEREAS,, it is appropriate and in the public interest that
said County Commissioners of Montgomery County be author-
ized and directed to incur said indebtedness whenever said
Fire Board shall so certify.
