192 LAWS OF MARYLAND. [CH. 190

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That whenever the Fire Board, created by Section 587 of
the Code of Public Local Laws of Montgomery County (1939
Edition), shall certify to the County Commissioners of Mont-
gomery County that it is possible, feasible and necessary to
expend money for the construction and equipment of a separate
Fire Department building for the Kensington Volunteer Fire
Department, Incorporated, including the purchase of a site for
said building, and to acquire certain additional equipment and
apparatus for said Fire Department, the County Commis-
sioners of Montgomery County shall forthwith borrow the
funds necessary to finance said construction and acquisition
and shall evidence said borrowing by the issue and sale, upon
its full faith and credit, of its negotiable, serial maturity
coupon bonds, provided said bonds can be issued and sold
within the limitations, conditions and restrictions contained in
this Act. Said certificate shall set forth generally the total
amount proposed to be expended on said new Fire Department
building, the total amount proposed to be expended for the site
of said building, the total amount proposed to be expended for
fire fighting equipment and apparatus and the balance, if any,
available for contingencies, maintenance, operation and up-
keep of said Fire Department and the property thereof. Said
certificate shall also clearly state that all necessary Federal
priorities or preference rating have been obtained for any
critical materials or equipment to be used in the construction
of said Fire Department building or for any of the apparatus
or equipment to be acquired, and said Fire Board shall state
in said certificate its opinion as to whether said critical ma-
terials, equipment or apparatus are obtainable in view of pre-
sent war conditions. At the conclusion of said certificate, said
Fire Board shall certify that the Kensington Volunteer Fire
Department, Incorporated is ready to proceed with the pro-
gram and shall request the County Commissioners of Mont-
gomery County to make available to said Kensington Volun-
teer Fire Department, Incorporated a sum of money, not ex-
ceeding in any event the sum of Forty Thousand Dollars
(|40, 000. 00), in order to assist said Kensington Volunteer
Fire Department, Incorporated to carry out said program in
whole or in part. Upon receipt of said certificate and upon
finding the same to be in compliance with the requirements of
this section, the Board of County Commissioners of Mont-
gomery County shall proceed forthwith, by resolution, to pro-
vide for the borrowing of the necessary funds and the evidenc-
ing of said borrowing by the issue and sale of the coupon bonds
of the County. Said bonds may be issued and sold at public
or private sale and without referendum, in the discretion of
the County Commissioners of Montgomery County, and the
