(61) TRAILER: Every vehicle without motive power de-
signed for carrying persons or property and for being drawn by
a motor vehicle and so constructed that no part of its weight
rests upon the towing vehicle.

(62) TRANSPORTER: Every person engaged in the business
of delivering vehicles of a type required to be registered here-
under from a manufacturing, assembling, or distributing plant
to point of destination.

(63) TRUCK TRACTOR: Every motor vehicle designed and
used primarily for drawing other vehicles and not so construct-
ed as to carry a load other than a part of the weight of the
vehicle and load so drawn.

(64) USED CAR DEALER: Every person, firm or corporation
actively engaged in the business of buying, selling or exchang-
ing used or second-hand motor vehicles and who has an estab-
lished place for the conduct of such business,

(65) VEHICLES: Every device in, upon, or by which any per-
son or property is or may be transported or drawn upon a
highway, excepting devices used exclusively upon stationary
rails or tracks or propelled by electric power obtained from
overhead trolley wires, but not operated upon rails or tracks.

(66) WRECKER: Every person, firm or corporation actively
engaged in the business of buying motor vehicles for the pur-
pose of dismantling such motor vehicles, and who has an estab-
lished place for the conduct of such business,

(b) The Department shall have authority, in disputed cases,
to determine the extent of the applicability of the definitions
herein contained.

ADMINISTRATION—REGISTRATION—TITLING.

3. DEPARTMENT CREATED, (a) A department of the gov-
ernment of this State to be known as the "Department of
Motor Vehicles" is hereby created.

(b) The Department shall succeed to and is hereby vested
with all the powers, duties, and jurisdiction now vested in the
Department heretofore known as the Commissioner of Motor
Vehicles.

4. OFFICE OF COMMISSIONER OF MOTOR VEHICLES CREATED.
The Department shall be under the control of a civil execu-
tive officer to be known as the "Commissioner, of Motor
Vehicles. " The Governor shall appoint by and with the con-
