ning of any construction whatsoever of a building or other
structure within the District without securing the approval
of a building permit by this Commission as herein provided,
is hereby declared a misdemeanor and punishable as other
misdemeanors are punishable under Section 2AA of this
Act. In any part of the District in which there does not
now exist provision of law or ordinance designating an ad
ministrative official by whom building permits are to be issued,
the appropriate District Council shall designate such official.
A District Council may provide in its zoning regulations
for the issuance of use and occupancy permits and for certi-
ficates by means of which zoning questions may be raised
previous to the preparation of all such structural specifica-
tions of a building as may be requisite for a complete build-
ing permit.

Z. The construction, reconstruction, erection, structural al-
teration or use of any building or other structure or the use
of land or premises in violation of any of the provisions of
this Act or of any of the provisions of any regulation enacted
under this Act or of any decision made under this Act is
hereby declared to be a misdemeanor. The wilful issuance
of a building, use or occupancy permit in violation of any
such provision or decision is hereby declared to be a misde-
meanor. The Commission, the Board of County Commis-
sioners of Montgomery or Prince George's County or the
prosecuting official of either of said counties may prosecute
any such violation; and, in addition to all other remedies
provided by law, the Commission, said Boards of County Com-
missioners, and public official of any municipality or political
subdivision within the District, or any neighboring property
owner or occupant may institute injunction, mandamus or other
appropriate action or proceeding to prevent such unlawful
construction, reconstruction, erection, alteration or use, and
any court of competent jurisdiction is hereby granted juris-
diction to issue restraining orders and temporary or perma-
nent injunctions or mandamus or other appropriate forms of
remedy or relief.

AA. Every act or omission designated as a misdemeanor
in this Act, unless otherwise provided, shall be punishable
before any justice of the peace or the Circuit Court of the
county in which such offense is committed, and the offender
shall, upon conviction, be subject to a fine not exceeding One
Hundred ($100. 00) Dollars or thirty (30) days in the County
Jail, or both, in the discretion of the Court. Where such an
act or omission is of a continuing nature or is persisted in,
in violation of the provisions of this Act or of any regulation
enacted or decision made under the powers granted in this
