SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 48 of Article 26 of the Annotated Code of
Maryland (1939 Edition), title "Courts", sub-title "Pensions
of Judges", as said section was enacted by Chapter 390 of the
Acts of 1941, be and the same is hereby repealed, and that a
new section be and it is hereby enacted in lieu thereof, said
new section to be known as Section 48, to follow immediately
after Section 47 of said Article, and to read as follows:

48. Every elected judge of the Circuit Court for any of the
counties, of the Supreme Bench of Baltimore City, and of the
Court of Appeals of Maryland, shall be paid, after the termina-
tion of active service, if he is then at least sixty years of age or
when he becomes sixty years of age, a pension or salary calcu-
lated at the rate of three hundred dollars ($300. 00) per annum
for each year, or any part thereof, of active service by appoint-
ment and election as a judge of the Circuit Court for any of the
counties, of the Supreme Bench of Baltimore City, and of the
Court of Appeals of Maryland, up to and including twenty
years of such active service, so that the maximum pension or
salary for such service payable hereunder to any one person
shall not exceed the sum of six thousand dollars ($6, 000. 00)
per annum. In the case of an elected judge who may serve on
the Court of Appeals subsequent or prior to service as a Cir-
cuit Court judge for any of the counties or of the Supreme
Bench of Baltimore City, the amount of pension per annum
shall be calculated according to the total years of active service
not exceeding twenty at the pension rate fixed herein. This
Act shall apply to all elected judges already retired from active
service. Any former judge who accepts any salaried public
office or position, municipal, county, State or Federal, shall
not be paid any pension or salary so long as he remains in such
office or position. The Mayor and City Council of Baltimore
and the County Commissioners of the several counties are here-
by expressly authorized to levy for and pay additional pensions
or salaries to such former judges of the Court of Appeals, the
Supreme Bench of Baltimore City and the Circuit Courts of
the counties who served or may hereafter serve in the judicial
circuits in which the City of Baltimore or any county exer-
cising the authority conferred herein is located; and any such
provision heretofore made is hereby ratified and confirmed.

SEC. 2. And I)e it further enacted, That the pension provided
in the aforegoing section shall, in the case of any elected judge
whose period of active service was five years or more but less
than ten years, and whose active service terminated before this
Act takes effect, be paid to such former judge from the date
when pensions became payable under Chapter 390 of the Acts
of the General Assembly of 1941, or from the date when his
