and Maintenance Fund to be used for the purpose
of employing, on reconstruction and maintenance of State
and county roads, prisoners in the penal institutions of
the State which institutions are under the control and di-
rection of the Board of Correction; ! and the said Board
of Correction is directed to furnish the said Commission,
for the above purposes, such prisoners as in its judgment
may be safely utilized for such work, the Board to be the
sole judge of whether such prisoners can be used for road
work with maximum security.
The employment of all prisoners on road work as herein
directed shall be subject to all the conditions and require-
ments now in force for such work, as prescribed in Article
27, Sections 799 to 813, inclusive, of the Code of Public
General Laws, provided that the money to be expended
hereunder shall provide for maintenance, safekeeping,
transportation, wages and all other expenses of utilizing
prison labor on the roads or for carrying out the purposes
of this Act, it being understood that nothing contained
herein shall prevent the State Roads Commission from
spending a greater amount than named in this Act if, in its
judgment, it shall be found to be for the best interest of
the State to do so.
Provided, however, that the Board of Correction shall
make arrangements for the employment of any prisoners
at any camp or camps in Queen Anne's County and in any
other county or counties in which similar camps are now
or may hereafter be established, in the harvesting and
gathering of any agricultural crops in the respective coun-
ties in which such camps are located between August 1st
and November 30th each year, except however any such
prisoners being utilized or needed by the State Roads Com-
mission for emergency road maintenance work in the re-
spective counties where such camps are located. Persons
who employ such prisoners from the Board of Correction
shall be required to pay the reasonable value of such labor
at the estimated prevailing wage scale for such work in
the community where the. prisoners are so em-
ployed and to give such security therefor as the
Board may, in its discretion, determine and require.
Persons employing such prison labor shall be authorized
to sell the produce harvested by such labor notwithstand-
ing the restrictions imposed by Section 762 of Article 27
of the Annotated Code. Prisoners so employed in the har-
vesting of crops shall be under the control and supervision
of the Board of Correction to the same extent as when
employed on the construction and maintenance of roads.
Provided, further, that if the number of prisoners at
any camp or camps in Queen Anne's County or in any other
