ment. The repeal by this Article of any provisions of law
shall not revive any law heretofore repealed or superseded, nor
shall any such repeal affect any act done, liability incurred, or
any right accrued or vested, or affect, or abate, or prevent any
right or penalty or punish any offense under the authority of
such repealed laws.

116. CONSTITUTIONALITY. If any clause, sentence, para-
graph, or section of this Article shall, for any reason, be ad-
judged by any Court of competent jurisdiction to be unconsti-
tutional and invalid, such judgment shall not affect, impair, or
invalidate the remainder thereof but shall be confined in its
operation to the clause, sentence, paragraph, or section thereof
so found unconstitutional and invalid.

117. And be it further enacted, That all game laws and
game and fresh water fish laws, whether general or local, ex-
cept as provided in this Article, be and they are hereby re-
pealed.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1943.

CHAPTER 709.
(Senate Bill 123)

AN ACT to authorize the Board of Public Works to apply
any excess receipts above a specified surplus for the fiscal
years ending June 30, 1943, and June 30, 1944, to the
State debt and to reduce the State Tax on real and per-
sonal property and/or the State income tax for such
fiscal years.

Whereas, real estate now bears a heavy and dispropor-
tionate share of the tax burden in this State; and

Whereas, the State should therefore help to alleviate this
condition by reducing the State real estate tax whenever
possible; therefore

SECTION 1. Be it enacted by the General Assembly of
Maryland, That if the revenues derived from the State
Income Tax and other sources of revenue, including the
surplus carried over from the preceding fiscal year for
the fiscal years ending June 30, 1943, and June 30, 1944,
exceed the appropriations for each of said years, as con-
tained in the State Budget for said years, by more than
Two Million Dollars ($2, 000, 000. 00), the Board of Public
