or owned by the State of Maryland and operated by it,
subject to the provisions of the Budget and Procurement
law, Article 15A of the Code.
7. The Commission shall appoint a Secretary, Com-
mander of the Fishery Force, Hydrographic Engineer,
Auditor, Chief Clerk, Chief Inspector and such other Dep-
uty Commanders, clerks, inspectors and employees as may
be provided for, from time to time, in the Budget, all of
whom shall perform such duties as the Commission may
prescribe. The Commission shall have power to require
any employee who handles funds, to furnish bond in such
amount as the Commission may determine. The Com-
mander of the Fishery Force, Deputy Commanders, in-
spectors and other employees who may be assigned to law
enforcement duties shall have all of the powers conferred
upon police officers or constables of this State, and such
powers may be exercised anywhere within the territorial
limits of this State. The Commander of the Fishery Force
shall receive an annual salary of $3, 500.
8. The Commission shall have charge of the inspection
of fish, crabs, terrapin, oysters, clams and other shellfish
wherever caught or sold in the State of Maryland and of
the enforcement of the cull laws and other protective
measures. Provided, however, that nothing in this section
is intended in any way to interfere with the inspections
made by the State Department of Health.
It shall be the duty of the Commission, through its
auditor, inspectors or other employees, to audit the books
of the various persons, firms and corporations packing or
dealing in fish, crabs, terrapin, oysters, clams and other
shellfish, including any catchers of the same who may
ship direct to market, for the purpose of ascertaining the
total number of bushels of oysters caught in the waters
of this State, the number of gallons shucked and shipped,
the pounds of crabs and crabmeat, quantities of soft crabs
and clams, quantities of each kind of fish, and also the
quantity in bushels and gallons of oysters that are im-
ported into the State.
9. Any person, firm or corporation buying or selling-
oyster shells shall report to the Commission, at such times
as the Commission may prescribe, each purchase or sale
of oyster shells, stating the number of bushels purchased
or sold, the date of sale, the name and address of the other
party to the transaction, and such other information as
the Commission may prescribe.
