421E. Licenses issued under the authority of this Act
shall be of two kinds: (1) "On sale" licenses, which shall
permit the licensee to sell beverages for consumption both
on and off the premises; and (2) "Off sale" licenses, which
shall permit the licensee to sell for consumption off the
premises only, not less than one-half dozen bottles or cans
of brewed beverages as defined in this Act, and not less than
one-fifth of a. gallon of fermented beverages as defined
herein; provided that no sales shall be made to any person
under the age of twenty-one (21) years.

421F. All applicants for "On sale" licenses shall pay to
said Liquor Control Board a licensee fee of One Hundred
and Fifty Dollars ($150) per annum, the same to be paid
before the license is issued; "Off sale" license fees shall be
Twenty-five Dollars ($25) per annum, payable in like man-
ner. Each kind of license shall expire on April 30th of each
year, unless sooner revoked by the Board; provided,
however, that licenses for portions of a year may in the
discretion of said Board be sold to bona fide seasonal clubs.

421G. "On sale" licenses shall be granted only to bona
fide restaurants, incorporated clubs, and/or hotels. "On
sale" licensees may serve beverages to bona fide guests
only, to be consumed at regular public tables, or, in the case
of hotels, may be served in guests' rooms: or such Keen-
sees may also sell for consumption off the premises, as pro-
vided in Section 421E. "Off sale" licenses shall only be
granted to proprietors of bona fide retail stores selling
food, drugs, or other similar commodities and items as des-
ignated by the Liquor Control Board under the provisions
of Section 421D.

The word "Hotel", as used in this section, means any
establishment for the accommodation of the public equipped
with not less than ten bedrooms, containing riot less than
one bed in each room, with sufficient covering therefor, and
equipped with a public dining room furnishing not less
than three meals per day, wherein the average daily re-
ceipts from the hire of rooms and the sale of cooked and
prepared foods exceeds the receipts from the sale of "alco-
holic beverages".

The word "restaurant", as used in this section, means an
establishment for the accommodation of the public, fully
equipped with a dining room and facilities for preparing
and serving regular meals, wherein the average daily re-
ceipts from the sale of foods cooked or prepared and served
on the premises where the license is exercised, and other
foods, commodities and items defined by the Liquor Con-
