668 LAWS OF MARYLAND. [CH. 403

WHEREAS, much of the statute law of this State concerning
the production, processing and sale of milk and milk products
is in many respects outmoded, impractical, insufficient and in-
adequate; and

WHEREAS because some of the said statute law is codified
under Article 27, title "Crimes and Punishments", and some
under Article 43, title "Health", it is not practical to revise
and modernize the same by repealing and re-enacting, but
resort must be had to the repeal thereof and the enactment of
sundry new sections, all to be codified under said "Health"
Article; therefore:

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Sections 323, 324 and 325 of Article 27 of the Anno-
tated Code of Maryland (1939 Edition), title "Crimes and
Punishments", sub-title "Health — Milk — Pure — Skimmed",
and Sections 497, 498, 499, 500, 501, 502, 503, 504, 505, 506, 507,
508, 509 and 510 of Article 43 of said Code, title "Health",
sub-title "Milk", be, and hereby are, one and all, repealed, and
that sundry new sections be, and hereby are, enacted in lieu
thereof, all to be codified under said Article 43 of the said
Code, title "Health", sub-title "Milk", to follow immediately
after said sub-title of said Article, to be numbered respectively
497, 498, 499, 500, 501, 502, 503, 504, 505, 506, 507, 508, 509,
510, 511, 512, 513, 514, 515, 516, 517, 518, 519, 520, 521, 522,
523, 524 and 525, and to read as follows:

497. The following definitions shall apply in the interpreta-
tion and the enforcement of this sub-title:

A. "Producer" is any person who owns, controls or operates
a dairy farm.

B. "Processor" is any person (other than a producer, unless
he is also a distributor) who pasteurizes or processes.

C. "Distributor" is any person (other than a producer,
unless he is a producer-distributor) who offers milk or milk
products for sale, at wholesale or retail, for consumption on
or off the distributor's premises.

D. "Producer-Distributor" is a producer who also operates
a retail distribution route.

E. "Bobtailer" is any person, other than a processor, who
operates a milk route on which he distributes milk which he
purchases from a processor.

F. "Health Authority" shall mean and refer to the duly
constituted State Department of Health, or its accredited
representative, except where such term relates to a city or
town having a population of not less than 100, 000 and main-
taining a municipal health department and an approved
