(b) The Insurance Commissioner shall seize and remove, at
the expense of the owner, all fireworks possessed or sold in
violation of this sub-title, the ownership thereof shall be for-
feited, and the same shall be destroyed.
81D. The Insurance Commissioner is authorized to grant
special permits for display of fireworks in places where the
discharge thereof will otherwise be legal. Such permit shall
not authorize the holder thereof to possess or discharge fire-
works in violation of any ordinance or regulation in effect
where the display is to be made and shall not relieve the appli-
cant from also obtaining any additional license or authority
which may be required by the governing body in said locality.
All applications for permits for public display as herein pro-
vided shall be made at least ten (10) days in advance of the
date of display. Said permit shall be non-transferable, and
shall be granted only after the Insurance Commissioner shall
have determined that the said display will not endanger the
health or safety of persons in the locality, or cause injury to
property belonging to others. Prior to granting the said per-
mit, the Insurance Commissioner shall require the applicant
to furnish a surety bond with corporate surety to be approved
by him in such penalty as the said Commissioner may pre-
scribe, not exceeding $10, 000. 00, conditioned upon the pay-
ment of all damages to persons or property caused by reason
of the discharge of fireworks mentioned in said permit. The
said bond shall be payable to the State and may be enforced
by any person suffering damage as aforesaid, by suit in the
name of the State to his own use. If claims under any bond
required under this sub-title are established to an amount
greater than the penal sum of the bond, such claims shall be
payable pro rata to the amount of the penal sum of the bond
and executions shall issue accordingly. The Insurance Com-
missioner is hereby authorized and directed to establish such
regulations as may be necessary for the enforcement of this
sub-title. He is hereby authorized to deputize the chief or
other members of the fire department serving in any locality,
or some other suitable official, to act as his deputy for the
purpose of making inspections and investigations and re-
ceiving applications for permits, and may provide for the
deposit with the application of a reasonable fee to cover ex-
penses incurred in investigation thereof.
81E. Nothing in this sub-title shall apply to the sale to,
possession of, or use of fireworks by the Federal, State or
municipal governments, nor to the sale to, possession of, or use
of combustibles or explosive preparations required by indus-
trial or commercial concerns for use as signals or otherwise
in the normal course of their business; nor to the use of flares,
