known as Sections 81A to 81F, and to follow immediately
after Section 81 of said Article, regulating the sale, posses-
sion and discharge of fireworks, defining fireworks, and pro-
viding penalties for the violation thereof.
SECTION 1. Be It enacted by the General Assembly of Mary-
land, That six new sections be and they are hereby added to
Article 48A of the Annotated Code of Maryland (1939 Edi-
tion), title "Insurance", to be under sub-title "Fireworks",
said new sections to be known as Sections 81A to 81F, to
follow immediately after Section 81 of said Article, and to
read as follows:
81 A. The term "fireworks" as used in this sub-title shall
mean fire-crackers, squibs, rockets, sparklers, Roman candles,
torpedoes, bombs, grenades, fire-balloons, signal lights, and
any combustible or explosive composition, or any substance or
combination of substances, or article prepared for the purpose
of producing a visible or an audible effect by combustion, ex-
plosion, deflagration, or detonation.
81B. (a) From and after June 1, 1941, it shall be unlawful
for any person to discharge fireworks without a permit granted
in the manner hereinafter provided, or to possess fireworks,
either with the intention of discharging or permitting the
discharge thereof in violation of the terms of this sub-title, or
for the purpose of disposal or sale to persons for use or dis-
charge without a permit, where such a permit is required by
this sub-title.
(b) It shall be unlawful for any person to sell fireworks to
any person or persons without a permit issued under this sub-
title except as hereinafter provided.
81C. (a) Any person possessing or discharging fireworks
in violation of the provisions of this sub-title shall be guilty of
a misdemeanor and shall be punished for each offense by a
fine of not more than $50. 00. Any person selling fireworks in
violation of the provisions of this sub-title shall be guilty of a
misdemeanor, and shall be punished for each offense by fine of
not more than $200. 00; provided, however, that nothing in
this sub-title shall prevent the manufacture of fireworks or the
possession of the materials for the manufacture of same, or
the storage thereof in any warehouse or building maintained
by the manufacturer of fireworks in the State of Maryland,
nor shall anything in this sub-title prevent any manufacturer
of fireworks from experimenting with pyrotechnics or ma-
terials used in the manufacture thereof, under such rules and
regulations as may be promulgated from time to time by the
Insurance Commissioner of Maryland.
