(1) Such sum as required may be used to defray the ex-
penses of the operation of this sub-title.

(2) The residue remaining after such expenditure to be
allotted and expended for the following purposes:

(a) 40% of the said residue, for the Anne Arundel County
Police Department.

(b) 60% for the maintenance, construction, repair and re-
construction of roads of Anne Arundel County, the said ex-
penditure for roads, to be in so far as possible in equal
sums for each district in Anne Arundel County, provided,
however, that no portion thereof shall be expended for any
road in the Sixth (6th) District, provided, however, that
60% of any money received from license fees for the oper-
ation of any carnival, circus, show, amusement ride, in any
incorporated Town, or Special Roads and Taxing District in
the First, Second, Third, Fourth, Fifth, Seventh and Eighth
Districts of Anne Arundel County, shall be expended for
the construction, reconstruction, maintenance and repair of
the roads therein, in accordance with the laws governing the
expenditure of road taxes of such incorporated Town or
Special Roads and Taxing District.

All allotments and expenditures of money as provided here-
in shall be determined and based on the sums collected from
license fees as of October 1 of each year, and shall be allotted
and the allotments shall be shown and designated in the Anne
Arundel County budget for the year following.

Provided, however, that no charge or fee shall be made for
any license for any carnival, circus, show, amusement ride,
amusement device operated for the promotion of the purpose
of any patriotic, educational, fraternal, religious, charitable,
benevolent, or civic organization or volunteer fire department.

SEC. 2. And be it further enacted, That if any word, phrase,
clause, sentence, or other part or parts of this Act or if any
section of this Act shall be held unconstitutional, such uncon-
stitutionality shall not affect the validity of the remaining
parts of this Act or any section thereof. The General Assem-
bly hereby declares that it would have passed the remaining
parts of this Act or any section thereof if it had known such
word, phrase, clause, sentence, part of parts or section would
be declared unconstitutional.

SEC. 3. And be it further enacted, That except as other-
wise provided herein, all acts, or parts of acts, and parts of
laws and ordinances inconsistent herewith or contrary hereto
be and the same hereby are repealed to the extent of such
inconsistency.
