said fund to be so administered in so far as possible, as to
maintain a sufficient balance for the purpose of providing
funds for repairing winter damage and making replace-
ments, and maintenance of said wharves.

423E. For the purpose of providing for the safety, pro-
tection and security and health of the residents of said Dis-
trict, the use of said wharves shall be limited to the em-
barking and disembarking of persons from pleasure boats
only, and no commercial, industrial or other use shall be
permitted of said wharves. The County Commissioners of
Anne Arundel County are authorized and empowered to
make regulations from time to time, relating to the moor-
ing of boats to said wharves and/or such other regulations
or restrictions as may be required to carry out the purpose
and intent of the use of said wharves, and may appoint
from the residents of the District a person or persons for
the purpose, of carrying out the provisions hereof relat-
ing to the use of said wharves, said person or persons so
appointed to be designated as Beverley Beach Wharf Cus-
todians, to have all the powers of Officers of the Peace of
the State of Maryland, in so far as may be required for the
purpose of enforcing said restrictions as to use of said
wharves, and the regulations of the County Commissioners
of Anne Arundel County appertaining to said wharves;
said Custodians, shall make oath to faithfully perform the
duties entrusted to them as provided in Article 1 Section 6
of the Constitution of Maryland, and shall perform the
duties entrusted to them, without pay or other compensa-
tion for their services, and shall furnish bond to the Coun-
ty Commissioners of Anne Arundel County in penalty of
Two Thousand Dollars ($2000. 00) conditioned "that said
Custodian shall well and faithfully execute the said office
in all things appertaining thereto", the cost of said bond
shall be charged as an expense against said Beverley Beach
Wharf Tax Fund, provided for in Section 423D hereof.

423F. All regulations and restrictions relating to the
use of said wharves, shall be posted in a prominent location
on or near said wharves, the cost of painting or printing
and erecting said notices to be charged against the said
Wharf Tax Fund. The regulations made by the County
Commissioners of Anne Arundel County relating to the
use of said wharves shall have all the force and effect of
laws of the State of Maryland. Any person violating any
of the restrictions as to use, or any regulation adopted
hereunder shall be guilty of a misdemeanor, and upon con-
viction thereof shall be fined not less than $1. 00 and not
more than $10. 00.
