add a new section to said Article, said new section to be
known as Section 430A and to follow immediately after
Section 430 of said Article relating to the payment of
pensions to certain members of the Fire Department of
Hagerstown.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 430 of Article 22 of the Code of
Public Local Laws of Maryland (19: 30 Edition), title
"Washington County", sub-title "Hagerstown", sub-head-
ing "Pensions", to be and it is hereby repealed and re-
enacted with amendments, and that a new section be and
it is hereby added to Article 22 of the Code of Public
Local Laws of Maryland (1930 Edition), said new section
to be known as Section 430A to follow immediately after
Section 430 of said Article and to read as follows:
430. Whenever any regular employed driver, tiller or
chauffeur of any of the fire companies which comprise the
Fire Department of Hagerstown shall have reached the age
of 65 years, he shall be retired, and if he shall have given
meritorious service as such employee for a period of at
least 15 continuous years prior to the date of such retire-
ment, he shall be paid by The Mayor and Council of Hag-
erstown during the remainder of his natural life a salary
or pension of $80. 00 per month.
Whenever any such driver, tiller or chauffeur shall have
given meritorious service as such employee for a period
of at least 15 continuous years, he shall be retired upon the
recommendation of the Chief Marshal of said fire depart-
ment, provided that after a physical examination given by
three physicians to be selected by said Chief Marshal and
acceptable to The Mayor and Council, it shall be found
that such employee is physically incapable of properly per-
forming the duties or services required of him, and that
such disability is permanent in its nature, whereupon such
employee shall be paid by The Mayor and Council of Hag-
erstown during the remainder of his natural life a salary
or pension of $80. 00 per month.
Whenever, after a physical examination given by three
physicians to be selected by said Chief Marshal and accept-
able to the Mayor and Council, it shall be found that any
such driver, tiller or chauffeur shall be physically incapa-
ble of properly performing the duties or services required
of him and that such disability is permanent in its nature
and is the direct result of an accident or injury occurring
in the course of duty while actively participating in fight-
ing a fire or while going to or coming from a fire, then
such employee shall be retired and he shall be paid by The
