WHEREAS by Act of the General Assembly of Maryland
of the November Session, 1779, Jacob Kerr and other citi-
zens of said Somerset County in said Act named were
created a body corporate under the name of The Trustees
of Washington Academy with right of perpetual succes-
sion for the purpose of maintaining and conducting an
Academy or Institution for the instruction of youth; and
whereas the said Corporation acquired certain real estate
situate at Princess Anne in said Somerset County by deed
from Eliza R. W. Waters dated September twelfth, eight-
een hundred and forty-three, and from Levin L. Waters,
et al, dated April twenty-seventh, eighteen hundred and
fifty-two, upon which was constructed and maintained an
Academy or School for the instruction of youth for many
years; and whereas by agreement between the said Trus-
tees and said Board of Education of Somerset County the
said School was taken over by the said Board of Educa-
tion and thereafter conducted by said Board as a public
high school; and whereas in furtherance of said agreement
the said Trustees of Washington Academy on the twenty-
sixth day of May, eighteen hundred and ninety-one, entered
into an agreement in writing with said Board of Educa-
tion to convey the aforesaid real estate to said Board for
the purposes aforesaid but the said deed was never exe-
cuted; and whereas thereafter the said The Trustees of
Washington Academy failed to keep up its succession by
election of successors to Trustees who died; and whereas
the said Robert F. Duer is the only surviving duly elected
member of said Board of Trustees.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the said Robert F. Duer as surviving Trus-
tee of the said The Trustees of Washington Academy be
and he is hereby authorized to convey to the Board of
Education of Somerset County, a body corporate and
politic under the laws of the State of Maryland, the afore-
said lots or parcels of land excepting any portion thereof
heretofore conveyed by the said The Trustees of Wash-
ington Academy and to execute on behalf of said last
named Corporation a deed of conveyance for said land.

SEC. 2. And be it further enacted, That this Act shall
take effect from the first day of June, nineteen hundred
and forty-one.
