sell or for any licensed dealer to deliver, give away or other-
wise dispose of any alcoholic beverages on Sunday. Any
person selling or any licensed dealer delivering, giving away
or otherwise disposing of such beverages in Talbot County or
in Worcester County on Sunday shall be guilty of a misde-
meanor and, upon conviction thereof, shall be fined not exceed-
ing fifty ($50. 00) dollars for the first offense and for each suc-
ceeding offense shall be fined not exceeding one hundred
($100. 00) dollars, or imprisoned in the County Jail for not
more than thirty (30) days, or be both fined and imprisoned,
in the discretion of the Court.

This section shall not apply to or affect Class F Licenses
issued under Article 2B of the Code of Public General Laws
of Maryland.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1941.

CHAPTER 167.

(House Bill 5)

AN ACT to repeal and re-enact, with amendments, Section 289
of Article 56 of the Annotated Code of Maryland (1939
Edition), title "Licenses", sub-title "Restaurants or Eating
Places", providing for the licensing of all restaurants or
eating places.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 289 of Article 56 of the Annotated Code of
Maryland (1939 Edition), title "Licenses", sub-title "Restau-
rants or Eating Places", be and the same is hereby repealed
and re-enacted, with amendments, to read as follows:

289. Each person, firm or corporation, resident or non-
resident, operating or conducting a restaurant or eating place,
shall, before doing so, take out a license therefor, and shall
pay an annual license fee of ten dollars ($10. 00) for each place
of business so operated except that in incorporated towns and
cities of 8, 000 inhabitants or over, the fee for each place of
business so operated shall be twenty-five dollars ($25. 00).

SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law, necessary for the immediate
preservation of the public health and safety, and being passed
