02 LATERAL ROAD CONSTRUCTION (1-Cent Gaso-
line Tax) :
To the State Roads Commission the proceeds of 100%
(less Refund Exemptions and less Payments of
Gasoline Tax Refunds to Incorporated Cities and
Towns) of the Lateral Road Gasoline Tax Funds,
1 % e. after deducting three-eighths (%) of that
sum appropriated for maintaining the Gasoline Tax
Collection Department in the office of the State
Comptroller, and after deducting an appropriation
not to exceed $10,000.00 for each of the fiscal
years (to be paid only in the discretion of and
upon the approval of the Board of Public Works)
to that Company who shall actually operate a ferry
boat or boats across the Chesapeake Bay from
Baltimore City or to and from any point approved
by the Public Service Commission of Maryland,
along the north shore of the Patapsco River, or to
and from any point on the western shore of the
Chesapeake Bay and tributaries north of the Pa-
tapsco River. The amounts named herein are com-
puted as estimates only, it being the intention that
these appropriations shall be 100% of the Revenue
aforesaid, and it being further the intention that
should the proceeds of this Tax exceed the respec-
tive amounts herein set forth, then such excess
shall not revert to the General Fund of the State,
but shall be set over to the use of the State Roads
Commission to be allotted by subsequent Legis-
lative action, in like manner as the sums hereby
requested. Out of the total Revenue as aforesaid,
the State Roads Commission shall receive 30% of
the net proceeds of the 100% for the use of Balti-
more City, for the construction and maintenance
of streets, highways and bridges, and other related
construction projects as may be performed within
the corporate limits of Baltimore City and/or
existing highway bond debt service. The remain-
ing 70% of the net produce of the aforesaid
Revenue shall be received and administered by the
State Roads Commission and by it apportioned in
the same manner and according to the sariife
formula and ratios as heretofore used, the basis
of which is the road mileage in each of the respec-
tive counties, to the use of the twenty-three coun-
ties, and expended by the Commission for the con-
struction of Lateral roads forming part of the
State or Federal System of Highways. In the
event the General Assembly, at the 1941 Session,
does pass an Act extending or modifying the pro-
