such a permit in event the applicant does not reside on the
premises where the sign is to be erected and the applicant
attempts to advertise the business or profession of another;
and to declare such unauthorized erection and maintenance to
be a misdemeanor punishable by fine of not less than Fifty
($50. 00) Dollars or commitment to the County Jail for a
period not exceeding one year, or both.

SEC. 124. If any person shall excavate any lot or part there-
of within the limits of the City for the purpose of obtaining
moulding sand or otherwise, to the depth of two feet or more,
and the said lot or part thereof shall remain uncovered, it
shall be the duty of such person to make and keep in good
repair good and sufficient underdrains that will carry off all
water that may collect and would otherwise remain in them
in the part thereof so excavated; and said under drains shall
be well covered and secured so as not to endanger or incom-
mode the public travel or other proper use of any street or alley
through which the same shall pass.

SEC. 125. In the excavation of any lot or part thereof, as
aforesaid, to a depth of two feet or more adjoining any of
. the streets or alleys in the City, it shall be the duty of the
owner of such lot to erect and keep in repair, good and suffi-
cient walls or fences along such streets and alleys or parts
thereof where such excavation so adjoins so as to effectively
protect such thoroughfares from injuries and render the use
thereof by the public safe and convenient.

SEC. 126. The Mayor and City Council shall grant the
temporary use of any street, alley or public thoroughfare of
the City which may be required by the owner of any excavated
lots, as aforesaid, to enable him to comply with the provisions
of the two preceding sections in constructing underdrains,
walls or fences, or in making grades.

SEC. 127. The Mayor and City Council shall have full power
to prescribe fines and penalties, not less than five nor more
than fifty dollars, against the owners of excavated lots, who,
after receiving ten days' notice in writing, shall refuse or
neglect to comply with the provisions of the three preceding
sections; and the fines and penalties prescribed as aforesaid
shall be recoverable in the name of the Mayor and City Coun-
cil before a Trial Magistrate of the City and, when collected,
shall be paid to the City Treasurer.

SEC. 128. It shall not be lawful for any person or persons,
after the passage of this Act, without the consent of the
