1850 LAWS OF MARYLAND. [CH. 935

Mayor and City Council of Havre de Grace, to excavate any
lot or lots in said City of Havre de Grace for the purpose of
obtaining moulding sand or otherwise to a greater depth
than two feet unless such excavation is for the real and bona
fide purpose of digging a foundation or foundations for a
building or buildings proposed to be erected, and for such
excavation as may be necessary for the use of such buildings
now erected or to be hereafter erected, and any persons
violating this section shall be subject to a penalty of not less
than Fifty ($50. 00) Dollars nor more than One Hundred
($100. 00) Dollars for every day during which such excavation
shall be made or be in existence, to be recovered as other fines
are recovered.

FIRE HAZARDS.

SEC. 129. The Mayor and City Council are authorized and
empowered to pass such ordinances as by requirements therein
contained affecting buildings or parts of buildings are in-
tended to protect the lives and property of the inhabitants of
the City against fire hazards and to provide for the arrest
and punishment of such property owners or tenants violating
the provisions of such ordinances after ten days' notice has
been given.

SEC. 130. Said ordinances may further provide that either
the Building Inspector or some other designated person or
persons may be named and qualified as Inspectors of either all
buildings or those suspected of violating the terms of such
ordinances, whose opinions or reports are to be deemed prima
facie correct.

SEC. 131. The burning of leaves, paper or other refuse in
any manner within the corporate limits of the City, either on
public or private property, is expressly prohibited.

ACQUISITION AND CONDEMNATION OF PROPERTY, OTHER THAN
UTILITIES, FOR PUBLIC USE.

SEC. 132. Whenever the Mayor and City Council shall by
ordinance order the opening of a new street or alley or the
purchase or construction of any park, public square, sewer
system, water mains or works, or other place for any other
public or municipal improvement whatsoever, including that
for the parking of automobiles, of any land or any right, title
or interest in or to any property of whatsoever description,
the Mayor, by and with the consent of the City Council, shall
appoint three legal voters and taxpayers of the City, not
office-holders, who, together with the Mayor and City Attorney,
