appoint a Board, consisting of five (5) persons, who shall
constitute and be styled "The Liquor Control Board for Mont-
gomery County". In making said appointments, the Board of
County Commissioners shall designate one of the appointees
to be Chairman of the Board. All members of the Board
shall be residents and voters of Montgomery County and per-
sons of high character, integrity and recognized business
capacity. The members of said Board shall serve at the
pleasure of the Board of County Commissioners and receive
such salaries as may be prescribed by the Board of County
Commissioners. In case of any vacancy, the Board of County
Commissioners shall appoint some eligible person to fill the
vacancy. The Clerk of the Board of County Commissioners
or such other person as may be designated by it, shall act as
the Clerk and Secretary of The Liquor Control Board for Mont-
gomery County.
65. The Liquor Control Board for Montgomery County shall
have full power and authority:
(1) to establish one or more dispensaries, stores or ware-
houses for the sale, distribution or storage of alcoholic bever-
ages at such locations as may be approved by resolutions of
the Board of County Commissioners;
(2) to acquire by lease, purchase or otherwise, subject to the
approval of the Board of County Commissioners, such real or
personal property as may be deemed necessary by the Liquor
Control Board to operate said dispensaries, stores or ware-
houses;
(3) to acquire, by purchase or otherwise, any alcoholic bev-
erage from any source for re-sale;
(4) to sell at and deliver from a dispensary, store or ware-
house any alcoholic beverage in a sealed package or container
(which may not be opened nor its contents consumed in said
dispensary) at a price to be fixed by it—
(a) to any member of the public not prohibited by law
from purchasing the same;
(b) to any licensed dealer who is authorized to re-sell
such beverage in Montgomery County, and
(c) to any person for shipment and delivery outside this
State.
It is the expressed intent of this Act to grant unto the
Liquor Control Board for Montgomery County an absolute
monopoly of the wholesale sale and distribution of all alco-
holic beverages within said county; and no person, firm,,
corporation or other association may sell any alcoholic bever-
age within said County not purchased from the Liquor Con-
trol Board of Montgomery County.
