of Maryland (1939 Edition), title "Forestry", said new sub-
title to be known as "Safety in the Use of Fire in the Open
Air", and said new sections to be known as Sections 47, 48,
49, 50, 51, and 52, and to follow immediately after Section
46 of said Article, conferring additional powers upon the
State Department of Forestry and the State Forester, rela-
tive to cooperation with the property owners within Har-
ford County in the safe use of fire for the disposal of in-
flammable debris; providing for the collection of the cost
thereof by the State Department of Forestry, from property
owners, when such fire operations are performed by the
State Department of Forestry in response to requests from
property owners; authorizing the State Forester to designate
fire prevention areas after notice and opportunity for ap-
peal, upon being satisfied that there has occurred in any
election District, a high annual forest fire loss resulting
from negligence in the use of fire in disposing of inflammable
materials; providing for the regulation of open air fires
within such areas, through issuance of permits, and pro-
viding for penalties for fires started within such areas with-
out such permits; said Act to apply in Harford County only,
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new sub-title and five new sections be, and the
same are hereby added to Article 39A of the Annotated Code
of Maryland (1939 Edition), title "Forestry", said new sub-
title to be known as "Safety in the Use of Fire in the Open
Air", and said new sections to be known as Sections 47, 48,
49, 50, 51, and 52, to follow immediately after Section 46 of
said Article, and to read as follows:
SAFETY IN THE USE OF FIRE IN THE OPEN AIR.
47. The State Department of Forestry shall, in addition
to the powers heretofore granted it, have the power to aid,
counsel and advise with tenants or property owners in the
vicinity of the woodland areas within the County or Counties
designated in Section 52 of this Article, as to means and
methods of safety conducting fires in the open air for the pur-
pose of burning grass, weeds, leaves, brush, stumps, logs,
fallen timber, slash, debris, rubbish, or other inflammable
material. When any person, organization, firm or corporation
shall apply to the State Department of Forestry for cooper-
ation and assistance in the use of fire for the disposal of in-
flammable materials in the open air, and the State Forester
deems an examination necessary, he shall instruct an author-
ized agent of the State Department of Forestry to examine
the situation where the burning is desired and to report con-
ditions with his recommendations to the State Forester. If,
