in the judgment of the State Forester, the burning will serve
a useful purpose, but is likely to endanger adjacent wood-
lands, he shall, if he deems it practicable, submit a plan for
conducting the desired operation in such a manner as to as-
sure protection to life and property, together with an estimate
to include a separate statement as to the cost of supervision if
performed by the State Department of Forestry and to be
submitted to the organization or persons from whom the ap-
plication originated.

48. No plan for safely burning inflammable materials shall
become operative under the preceding Section of this sub-title
until such plan has been approved by the organization or per-
son making the application and until the said organization or
person guarantees to the State Department of Forestry the
cost of supervising the work, in which the said organization or
person may stipulate a maximum amount that it or he will
guarantee. Upon proper assurance that such a guarantee has
been given, and that the burning is desired, the State Forester
shall direct a Forest Warden or other authorized agent of the
State Department of Forestry, to complete arrangements for
safely performing the desired burning operation in cooperation
with the organization, or person guaranteeing the cost of the
work. The Forest Warden shall proceed with the work in
accordance with the plan approved by the State Forester, at
such time and in such manner as in the judgment of the For-
est Warden will be most practicable, but in executing such
plans he shall work under the direction of the State Forester.
If, in the opinion of the Forest Warden in charge of the burn-
ing operation, at any time during the progress of the work,
there is a possibility of endangering forests, brushlands, forest
products, improvements or other property, he shall immediate-
ly suspend the use of fire, taking all necessary action in ex-
tinguishing the remaining embers, sparks, or glowing coals
and placing an adequate number of watchmen on the area until
the fire is entirely safe. Upon the arrangement for additional
means for safety or the occurrence of more favorable weather
conditions of such a nature that the burning operation will
no longer be a danger, the Forest Warden shall resume the
work in accordance with the plan of the State Forester. Noth-
ing in this Act shall be construed as imposing any liability
upon the Department of Forestry or its duly authorized agents
for acts performed, or damages resulting from the setting of
fire.

49. For his services in making examinations as provided in
Section 47 of this Article, the Forest Warden shall be paid
by the State Department of Forestry upon presentation of
his account with vouchers approved by the State Forester;
