to follow immediately after Sub-section (2) of Section 26
of said Article, and to add a new section to said Article,
said new section to be known as Section 28A and to fol-
low immediately after Section 28 of said Article, relating
to vacancies in the membership of the Legislative Coun-
cil, conferring certain additional powers upon the Leg-
islative Council.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That a new sub-section be and it is hereby added
to Section 26 of Article 40 of the Annotated Code of Mary-
land (1939 Edition), title "General Assembly", sub-title
"Legislative Council", said new Sub-section to be known
as Sub-section (3), to follow immediately after Sub-section
(2) of Section 26 of said Article, and to read as follows:

26. (3) Any vacancy occurring in the membership of
the Council while the General Assembly is not in session
shall be filled by appointment by the President of the Sen-
ate from among the members of the Senate, if the vacancy
is caused by the resignation or death of a member of the
Council from the Senate, and by the Speaker of the House
of Delegates, if the vacancy is caused by the resignation or
death of a member of the Council from the House of Dele-
gates, the appointments to be made in accordance with the
provisions of Sub-sections (1) and (2). If the vacancy is
caused by the resignation or death of the Chairman or
Vice-Chairman, the vacancy shall be filled by the members
of the Council from the membership of the Senate or the
House of Delegates, as the case may be.

SEC. 1A. And be it further enacted, That a new section
be and it is hereby added to said Article 40 of the Anno-
tated Code of Maryland (1939 Edition), title "General
Assembly", sub-title "Legislative Council", said new sec-
tion to be known as Section 28A, to follow immediately
after Section 28 of said Article, and to read as follows:

28A. In the discharge of any of its functions or pow-
ers, the Council shall have the authority to administer
oaths, issue subpoenas, compel the attendance of witnesses
and the production of any papers, books, accounts, docu-
ments and testimony, and to cause the deposition of wit-
nesses, residing either within or without the State, to be
taken in the manner prescribed by law for taking deposi-
tions in civil actions in the circuit courts. In case of
disobedience on the part of any person to comply with a
subpoena issued in behalf of the Council, or on the refusal
of any witness to testify to any matters regarding which
