he may be lawfully interrogated, it shall be the duty of the
circuit court of any county, or of any judge of the Su-
preme Bench of Baltimore City, on application of a mem-
ber of the Council, to compel obedience by proceedings for
contempt, as in the case of disobedience of the require-
ments of a subpoena issued from such court or a refusal
to testify therein. False swearing by any witness before
the Council shall constitute and be punishable as per-
jury.

SEC. 2. And be it further enacted, That this Act shall
take effect June 1, 1941.

CHAPTER 888.
(Senate Bill 71)

AN ACT to repeal and re-enact, with amendments, Section
9 of Article 89B of the Annotated Code of Maryland
(1939 Edition), title "State Roads", relating to the allo-
cation and expenditure of the one and one-half cent lat-
eral road gasoline tax fund and eliminating Carroll
County and Garrett County from the list of counties
whose roads are maintained by the State Roads Com-
mission and relating to the letting of certain contracts
by the Board of County Commissioners of Garrett
County, by competitive bidding.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 9 of Article 89B of the Annotated
Code of Maryland (1939 Edition), title "State Roads", be
and it is hereby repealed and re-enacted, with amendments,
to read as follows:

9. The "One and One-half Cent Lateral Road Gasoline
Tax Fund", created by Section 243 of Article 56 of the An-
notated Code of Maryland, as said Section is amended by
Chapter 766, Acts of 1939, shall be disbursed by the State
Treasurer monthly (less such sum to be retained by the
Comptroller, as in the judgment of the Comptroller, shall
be sufficient to enable him to pay promptly all claims for
refunds, and less three-eights of the appropriation to the
Comptroller for maintaining the Gasoline Tax Collection
Department in the office of the Comptroller), as follows:
