CHAPTER 878.
(Senate Bill 466)

AN ACT to repeal and re-enact with amendments Sec-
tions 52 and 60 of Article 99 of the Annotated Code of
Maryland (1939 Edition), title "Water Fowl-Birds and
Game", sub-title "Susquehanna Flats", providing a
definition of "gunning days" on said Flats; and for
changes in the limits of the closed area or sanctuary
on said Flats, and providing authority to the State Game
Warden to lease said area to the United States of
America, for the use of the Fish and Wildlife Service
of the U. S. Department of the Interior.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Sections 52 and 60 of Article 99 of the
Annotated Code of Maryland (1939 Edition), title "Water
Fowl-Birds and Game", sub-title "Susquehanna Flats", be
and the same are hereby repealed and re-enacted with
amendments to read as follows:

52. For the purposes of this sub-title, a gunning rig
is defined as a craft, boat or boats or sink box, customari-
ly used or intended to be used in connection with sink-
box shooting, or a flat bottom bateau or boat with bush
or canvas blinds (commonly known as a sneak-boat or
bush-whacking outfit) which shall be without power, ex-
cept oars, and may be engaged in shooting or gunning
over decoys. No boat used as a sneak-boat or for bushwack
shall be of dimensions less than sixteen (16) feet in
length, nor less than twenty (20) inches at the lowest
point in height. "Any gunning day referred to in this sub-
title, shall mean Tuesdays, Thursdays and Saturdays of
every week during the gunning season; and it shall be un-
lawful for any gunning rig to be on the Susquehanna Flats
for the purpose of gunning, on any other days in the week;
provided however, that if the Federal Government, or any
agency thereof at any time bans gunning on the said Flats
on any one or all of these days in the week, then this Act
shall no longer be effective.

60. The area of land under water, and the waters there-
over, in Harford and Cecil Counties hereinafter described
are hereby designated and established as an inviolate
sanctuary and refuge for the preservation of migratory
birds under the administration and supervision of the
Maryland State Game and Inland Fish Commission, or its
successor, and in or on which it shall be unlawful to hunt,
