CHAPTER 115.
(House Bill 60)

AN ACT to repeal and re-enact, with amendments, Section 42
of Article 2B of the Annotated Code of Maryland (1939
Edition), title "Alcoholic Beverages", sub-title "Regulations
and Restrictions", to make unlawful the sale of any alco-
holic beverages on Sunday in Wicomico County or the deliv-
ery, giving away or other disposition of alcoholic beverages
by any licensed dealer on Sunday in Talbot or Wicomico
Counties.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 42 of Article 2B of the Annotated Code of
Maryland (1939 Edition), title "Alcoholic Beverages", sub-
title "Regulations and Restrictions", be and it is hereby re-
pealed and re-enacted, with amendments, to read as follows:

42. (General Regulations, Hotels, Restaurants and Clubs—
Restrictions After Midnight and on Sunday. ) No retail dealer
shall be permitted to sell any alcoholic beverages at a bar or
counter at any time between the hours of midnight and 6 A.
M. or at any bar or counter on Sunday. In Talbot and
Wicomico Counties, it shall be unlawful for anyone to sell,
or for any licensed dealer to deliver, give away or otherwise
dispose of any alcoholic beverages on Sunday. Any person
selling, or any licensed dealer delivering, giving away or other-
wise disposing of, such beverages in Talbot County or in
Wicomico County on Sunday shall be guilty of a misdemeanor
and, upon conviction thereof, shall be fined not exceeding
fifty ($50. 00) dollars for the first offense and for each succeed-
ing offense shall be fined not exceeding one hundred ($100. 00)
dollars, or imprisoned in the County Jail for not more than
thirty (30) days, or be both fined and imprisoned, in the dis-
cretion of the Court.

This section shall not apply to or affect Class F. licenses
issued under Article 2B of the Code of Public General Laws
of Maryland.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1941.
