1308 LAWS OF MARYLAND. [CH. 757

Maryland, title "Montgomery County", sub-title "Roads", said
new section to be known as Section 855A, to follow immedi-
ately after Section 855 of said Code, and to read as follows:

855A. (a) The Board of County Commissioners is hereby
authorized to expend any part of the Suburban Tax District
Funds or any other revenue accruing to the Suburban Dis-
tricts in Montgomery County for the grading, construction,
maintenance or drainage of roads, streets, or highways in
said Suburban Districts.

(b) The said Board shall also have the power to expend
any other revenue accruing to Montgomery County, or any
taxes which said Board in its discretion shall deem necessary
to levy, without limitation as to amount, for the maintenance,
construction, improvement or drainage of streets, roads or
highways in any part of said County..

(c) All County-wide levies for roads or County-wide rev-
enues used for road purposes, and, as far as may be prac-
ticable, the County's share of the Lateral Road Gasoline Tax
Fund shall be allocated as follows:

1/3 to the 1st, 2nd and 3rd Commissioner Districts;

1/3 to the 4th Commissioner District;

1/3 to the 5th Commissioner District.

(d) After the adoption of a resolution or ordinance to that
effect, the Board of County Commissioners may enter into a
written contract with any person, firm or corporation who is
engaged in promoting a real estate development or sub-division
in the Montgomery County Suburban District, to participate
in the cost of street, sidewalk, gutter, curb or drainage con-
struction in a public street or road dedicated to the public
use. Such resolution or ordinance shall be deemed to be an
acceptance by the County of said offer of dedication.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1941.

16 of the Code of Public Local Laws of Maryland (1930 Edi-
