have been so bid for shall be awarded by said County Com-
missioners to the highest responsible bidder or bidders there-
for, for cash, if the prices bid are adequate in the judgment
of the said County Commissioners, and when two or more
bidders have made the same bid, and such bid is the highest
and the notes so bid for by the highest responsible bidders
are in excess of the whole amount of the notes offered for
sale, such notes shall be awarded to such responsible bidders
bidding the same price in a ratable proportion; and if any
of said notes so offered for sale are not bid for, or if an insuffi-
cient price be bid for them, they may subsequently be disposed
of under the direction of said County Commissioners, at a
private sale, upon the best terms they can obtain for the same;
and provided further that said County Commissioners, in their
discretion, shall have the right to reject any and all bids.
SEC. 4. And be it further enacted, That the actual proceeds
of the sale of said notes if issued shall be used exclusively for
the following purposes, to wit:
(a) The payment of the cost of engraving or printing of
said notes, and for the payment of the cost of advertising
authorized by this Act and all other incidental expenses in
'Connection with the issuance of said notes.
(b) The remainder of the proceeds of the sale of said notes
shall be used by the County Commissioners of Montgomery
County, and shall be used, expended and applied by the said
Board for the purchase of voting machines used at elections
held in Montgomery County, in accordance with the provisions
of Chapter 337 of the Acts of the General Assembly of 1937,
and any amendments thereto.
SEC. 5. And be it further enacted, That for the purpose of
paying the interest on all or any of the notes hereinabove
authorized and for the purpose of paying the notes themselves
as they respectively mature and are payable after the issue
and sale thereof pursuant to the provisions of this Act, the
Board of County Commissioners of Montgomery County shall
annually until all the said notes issued under the provisions
of this Act shall have matured and have been paid, levy a tax
upon all the assessable property in said county sufficient to
pay the annual interest on all of said notes that may be issued
and outstanding as said interest becomes due and payable, and
also a tax in each year upon all said assessable property in
said county sufficient to pay the principal of said notes as said
notes respectively mature and are due and payable.
SEC. 6. And be it further enacted. That this Act is hereby
declared to be an emergency law and necessary for the imme-
