tion to be known as Section 37A and to follow immediately
after Section 37 of said Article, relating to the creation and
operation of a pension system for the members of the Fire
Department of the City of Cumberland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
1A of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "City of Cumberland", sub-title "Police and Fire",
said new section to be known as Section 37A, to follow imme-
diately after Sections 37 of said Article, and to read as fol-
lows:

37A. (a) There is hereby created a Board to be known as
The Fire Department Pension Fund Board, composed of six
members, for the regulation, control and distribution of the
pension Fund set up under this Section. Said Board shall
consist of the Mayor, the Commissioner of Police and Fire, the
City Auditor and three members of the Department of Fire;
one to be elected from among the officers and two to be elected
from among the ranks by the participants of the fund as they
are hereinafter defined.

(b) The Commissioner of Police and Fire shall be the Presi-
dent of the Board and the City Solicitor shall be its Attorney,
for which there shall be no additional compensation.

(c) The elective members of the Board shall be elected
either by direct vote or by proxy, at the regular April meet-
ing of the Board.

(d) There shall be a secretary elected annually by the Board
from among its members, and it shall be his duty to keep an
accurate record of the minutes of all regular and special meet-
ings held by said Board, and perform all and any other duties
which the Board may, from time to time, direct. Said Secre-
tary may be paid a salary at such time and in such amount
as the Board may, in its discretion, determine, and said sal-
ary, if any foe paid, shall be paid from the pension fund.

(e) The participants Of the fund shall include all members
now or hereafter accredited as members of the Department of
Fire. Extra and probationary members shall be eligible to
membership in this fund and shall be credited for pension and
pay for actual days served in the Department. Regular, pro-
bationary and extra, members shall serve at least fifteen days
in each month and appear on both semi-monthly payrolls of
the Department in said month, in order to be credited for one
month's service for pension tinder this fund.

(f) Any member of the Department of Fire, accredited to
this fund, shall, under the regulations hereinafter prescribed,
be retired from the service of the Department of Fire of the
