cinct of this State on the day in which an election is held
therein and to amend the provision for disposition of fines
and to repeal all other laws, whether Public General or
Public Local Laws, prohibiting the sale of alcoholic bever-
ages on any general, special or primary election day.

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That Section 121 of Article 33 of the Annotated Code of
Maryland (1924 Edition), title "Elections, " sub-title "Of-
fenses" be and the same is hereby repealed and re-enacted
with amendments to read as follows:

121. It shall be unlawful for the keeper of any hotel, tav-
ern, store, drinking establishment or any other place where
liquors are sold, or for any person or persons, directly or in-
directly, to sell, barter, give or dispose of any spirituous or
fermented liquors, ale or beer, or intoxicating drinks of any
kind within any election district or precinct of this State on
the day of any election hereafter to be held in such district or
precinct; any person violating the provisions of this section
shall be liable for indictment, and shall, upon conviction, be
fined not less than fifty (50. 00) dollars, nor more than one
hundred ($100. 00) dollars for each offense.

SEC. 2. And be it further enacted, That all other laws
whether Public General or Public Local Laws, and particu-
larly all provisions of Article 2B of the Annotated Code of
Maryland (1935 Supplement) prohibiting the sale of alcoholic
beverages on general, special or primary election days, be and
they are hereby repealed.

SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency law, necessary for the immediate
preservation of the public health and safety, and being passed
upon a yea and nay vote, supported by three-fifths of all of
the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage.
