CHAPTER 224.
(House Bill 298)
AN ACT to repeal an re-enact, with amendments, Section
198A of Article 16 of the Code of Public Local Laws of
Maryland (1930 Edition), title "Montgomery County", sub-
title "County Commissioners and Treasurer", as the same
was enacted by Chapter 187 of the Acts of the General As-
sembly of Maryland at its Regular Session of 1935, so as to
provide for the employment of Special Attorneys and Gen-
eral Attorneys and provide for their compensation.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 198A of Article 16 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Montgomery
County", sub-title "County Commissioners and Treasurer", as
the same was enacted by Chapter 187 of the Acts of the Gen-
eral Assembly of Maryland at its Regular Session of 1935, be
and it is hereby repealed and re-enacted with amendments to
read as follows:
198A. The Board of County Commissioners of Montgomery
County shall have the power and authority to employ an
attorney or firm of attorneys to furnish legal services and
advice to the Board of County Commissioners. Such attorney
or firm of attorneys shall hold office at the pleasure of the
County Commissioners, and shall receive a salary not exceed-
ing Three Thousand ($3, 000. 00) Dollars a year, payable
monthly, in equal installments, which shall be in lien of all
other fees and compensation for services rendered by such at-
torney or firm of attorneys to the said County Commissioners.
The Board of County Commissioners shall have the authority
at any time to employ and compensate special Counsel when
its regular Counsel is disqualified and also to employ special
Counsel for the purpose of preparing proposed legislation re-
lating to the administration of the County or its fiscal affairs,
or for the purpose of passing upon the validity of any securi-
ties to be issued or purchased by the County and to pay the
fees either out of the proceeds of such securities if sold, or out
of any available funds of the County. Said Board of County
Commissioners are further authorized to compensate F. Bar-
nard Welsh for services rendered the County Commissioners
subsequent to January 31, 1939.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
