cies or subsequently created positions in said County police
or park police shall be made only from among the first ten
names on the current list certified to the Board of County
Commissioners by the Police Civil Service Commission, as is
required by Section 2 of this Act, provided, however, that this
requirement shall not apply to the first appointment of the
forty-five (45) County Police and five (5) park police as is
provided for in this Act. Each appointee shall be examined
by the Health Officer of Montgomery County and a written
report of his physical condition submitted by said Health Offi-
cer to the Board of County Commissioners, before such ap-
pointment is final. In the event his physical condition is not
satisfactory to said Board, the name of such appointee shall
be dropped from the list, he shall be so notified, and some
other person from among the first ten names on said list shall
be selected for appointment, after passing said physical ex-
amination to the satisfaction of the Board.

Sec. 4. The Board of County Commissioners shall appoint, in
addition to the above mentioned officers, a suitable and quali-
fied person as Chief of the Montgomery County Police, at a
salary not to exceed the sum of Thirty-six Hundred ($3, 600. 00)
Dollars per annum, payable in equal monthly instalments
which shall be in lieu of the salary of Twenty-five hundred
$2, 500. 00) dollars and expense allowance of four hundred
($400. 00) dollars provided for by Chapter 9 of the Acts of
1935 and the five hundred ($500. 00) dollars increase in salary
provided for by Chapter 57 of the Acts of 1937. Said Chief of
Police shall have control and supervision over the other mem-
bers of the force, fix such duties, at such hours, as said Chief
of Police may think proper, subject, however, at all times to
such rules, orders and regulations as the County Commis-
sioners may from time to time prescribe and, provided, that
not less than twelve (12) of said officers shall during the time
they are on duty be assigned to motorcycle patrol duty; and
provided further that a member of said Police shall be as-
signed to duty at all times in the municipal limits of the town
of Kensington and said officer shall patrol the streets and
highways of the third precinct of the 13th election district.

Sec. 5. The County Commissioners of Montgomery County
shall designate seven (7) of the said police officers so ap-
pointed as sergeants of the Montgomery County Police at a
salary not to exceed the sum of Twenty-four Hundred Dollars
($2, 400. 00) per annum, payable monthly, and shall designate
four (4) of said police officers so appointed as patrolmen,
"first-class", of the Montgomery County police at a salary not
to exceed the sum of Two Thousand, One Hundred ($2, 100. 00)
