HERBERT R. O'CONOR, GOVERNOR. 1541

WHEREAS, The Secretary of Agriculture of the United
States of America, by virtue of the authority vested in him by
Section 3 of the Migratory Bird Treaty Act of July 3, 1918
(40 Stat. 755, U. S. C. 16, 704). is authorized and directed to
regulate the hunting, taking, capturing, and killing of migra-
tory birds in or on such areas as shall be determined after a
study of the distribution, abundance, economic value, breed-
ing habits, and lines of flight of such birds; and

WHEREAS, The Secretary of Agriculture, after thorough con-
sideration, has selected an area of water in Chesapeake Bay,
near the mouth of the Susquehanna River, in Harford and
Cecil Counties, which area is controlled by the State of Mary-
land; now, therefore

SECTION 1. Be it enacted by the General Assembly of Mary-
land,
That the area of water in Harford and Cecil Counties
hereinafter described be designated as closed area in or on
which hunting, taking, capturing, or killing, or attempting
to take, capture, or kill migratory birds is prohibited. Noth-
ing in this Act shall be construed as in any wise affecting the
right of navigation in and over the waters affected by this
Act, the said area being bounded as follows:

Beginning at a point in the Chesapeake Bay on the west side
of Elk Neck, 440 yards distant from the shore line thereof, at
latitude 39°30' N.; thence in a southwesterly direction with a
line parallel to and 440 yards distant from the shore on the
west side of Elk Neck, to a point off Turkey Point, the south-
ernmost extremity of Elk Neck from which the navigation
bell on said point bears S. 70° E., 2, 400 feet distant (approxi-
mate); thence N. 62½° W., (approximate) to a point in Chesa-
peake Bay, 440 yards distant from the northeast side of
Spesutie Island at Locust Point; thence north and west along
the north shore of Spesutie Island and 440 yards therefrom, to
a point opposite the center of Sepsutie Narrows, and thence
westerly and northerly and 1, 000 yards distant from the east
side of the channel lying close to the west shore, to the said
latitude 39 degrees, 30 minutes (at a point 1, 000 yards east
of said channel); and thence due east to the place of be-
ginning.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1939.
