1470 LAWS OF MARYLAND. [CH. 705

of the Code of Public Local Laws of Maryland (1930 Edition),
title "Montgomery County", sub-title "Chevy Chase—Section
2", said new section to be known as Section 87A to follow
immediately after Section 87 of said Article, and to read as
follows:

87A. After the effective date of this Act, the following de-
scribed property shall be deemed to be included within the
special tax area or district defined in Section 87 hereof.

"Section 1 as per plat recorded in Plat Record, Book No.
4, page 312 of the Land Records of Montgomery County, ex
eluding that part of Cedar Parkway lying west and westerly
of the center line of said Cedar Parkway as shown on said
Platt. "

All of the provisions of the Public Local Laws of Maryland
pertaining to the special taxing area or district defined in Sec-
tion 87 hereof, including those contained in this Act, and the
regulations heretofore enacted by the Citizens' Committee
thereof, shall be and the same are extended and made applicable
to the territory by this Act annexed to said special taxing area
or district, and to the inhabitants thereof. The property in
the territory so annexed shall be subject to levy in the same
manner and to the same extent as the property in the special
taxing area or district defined in Section 87 hereof, the first of
such levies to be made at the annual levy of taxes of said spe-
cial taxing area or district for the year 1939.

SEC. 2. And be it further enacted, That Section 90 of Article
16 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Montgomery County", sub-title "Chevy Chase—
Section 2" be and the same is hereby repealed and re-enacted,
with amendments, to read as follows:

90. Said Chevy Chase Citizens' Committee is empowered to
grade, pave, macadamize or otherwise improve any existing
dedicated street, road or lane, or any county road, street or
lane, which has been, or which may be acquired and opened
for public use, but which is ungraded, unpaved, or unimproved,
and to lay sidewalks and curbs thereon, provided, that said
Citizens' Committee, subject to the approval of the Board of
County Commissioners and after due publication thereof, shall
have power to assess the cost of said grading, paving, macada-
mizing, or improving against the property abutting on said
street, road, lane or sidewalk, in proportion to the frontage of
said abutting property on the same. Said Citizens' Com-
mittee, subject to the approval of said Board of County Com-
missioners, is also further empowered, and after due public
notice thereof, to acquire by purchase, condemnation or other-
