1284 LAWS OF MARYLAND. [CH. 633

SEC. 34. And be it further enacted, That if any word,
phrase, clause, sentence, or other part or parts of this Act
or if any section of this Act shall be held unconstitutional,
such unconstitutionally shall not affect the validity of the
remaining parts of this Act or of any section thereof. The
General Assembly hereby declares that it would have passed
the remaining parts of this Act or any section thereof if it
had known such word, phrase, clause, sentence, part or parts
or section would be declared unconstitutional.

SEC. 35. And be it further enacted, That, except as other-
wise provided herein, all Acts or parts of Acts, laws and parts
of laws or ordinances inconsistent herewith or contrary here-
to be and the same are hereby repealed to the extent of such
inconsistency.

SEC, 36. And be it further enacted, That this Act shall not
apply, restrict or interfere in any manner whatsoever with
any legal right or control of the Anne Arundel County Sani-
tary Commission, a body corporate, within the Sanitary Dis-
trict, sub-district or any other district or sub-district in which
it may legally assume jurisdiction; and shall not be taken as
restricting any control which the State Board of Health of
Maryland is empowered to exercise in any Sanitary District or
any Sanitary District which may be incorporated in the future.

SEC. 37. And be it further enacted, That this Act shall not
become effective until it shall have ben submitted for adoption
or rejection to the qualified voters of Anne Arundel County at
the regular Congressional election to be held in November,
1940. There shall be printed on the ballots to be used at said
election the title of this Act and underneath said title on
separate lines a square or box to the right of and opposite the
words "For Planning and Zoning Bill" and a corresponding
square or box to the right of and opposite the words "Against
Planning and Zoning Bill", so that the voters shall be able to
designate by a cross-mark in the proper square or box his
or her decision for or against said question. If a majority
of the votes cast on said question shall be "for Planning and
Zoning Bill" then this Act shall become immediately effective;
but if a majority of the votes cast thereon shall be "Against
Planning and Zoning Bill" then this Act shall be null and void
and of no effect whatsoever.

SEC. 38. And be it further enacted, That this Act shall take
effect June 1, 1939.
