ishable before any justice of the peace or the Circuit Court
of the county in which such offense is committed, and the
offender shall, upon conviction, be subject to a fine not ex-
ceeding twenty-five dollars ($25. 00). Where such act or omis-
sion is of a continuing nature or is persisted in, in violation
of the provisions of this Act or of any regulation enacted or
decision made under the powers granted in this Act, each and
every day during which such act or omission continues or is
persisted in shall be deemed a separate misdemeanor.

SEC. 31. And be it further enacted, That for the purposes of
this Act, the word "road" or "roads" means, relates to and
includes, roads, highways, freeways, boulevards, parkways,
streets, avenues, lanes, alleys, viaducts, bridges and all other
ways or part or parts thereof; the word "park" or "parks"
means, relates to and includes parks, playgrounds, playfields
and all other recreational grounds and spaces; the word "sub-
division" means the division of a lot, tract or parcel of land
into two or more lots, plots, sites, tracts, parcels or other
divisions for the purpose, whether immediate or future, of sale
or building development, and includes re-subdivision and, when
appropriate to the context, relates to the process of sub-
dividing or to the land or area subdivided; provided that the
definition of subdivision shall not include a bona-fide partition
of exclusively agricultural land not for development pur-
poses.

SEC. 32. And be it further enacted, That the powers or any
of them vested by Chapter 599 of the Laws of Maryland of
1933 in any municipality or council of any municipality or
in any board of county commissioners shall, within the Dis-
trict, be construed to be vested exclusively in and may be ex-
ercised within its discretion only by the District Council.

Within the District any power vested by Chapter 599 of the
Laws of Maryland, 1933, in any planning commission or board
of appeals shall be construed to be vested exclusively in and
may be exercised only by the Commission or the Board of
Zoning Appeals created or authorized by this Act.

Insofar as the provisions of said Chapter 599 of the Laws
of Maryland, 1933, may be inconsistent with or contrary to
the provisions of this Act, such provisions of the Act of 1933
shall have no application within the District.

SEC. 33. And be it further enacted, That nothing contained
in this Act shall impair the continued effectiveness of any
zoning ordinance heretofore enacted by the Mayor, Counselor
and Aldermen of the City of Annapolis until such ordinance
be supplanted, amended or repealed under and in accordance
with the provisions of this Act.
