CHAPTER 598.
(House Bill 734)
AN ACT to add a new section to Article 23 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Wi-
comico County", sub-title "Salisbury", said new section to
be known as Section 293A and to follow immediately after
Section 293 of said Article, granting to the Mayor and Coun-
cil of Salisbury additional powers to pass ordinances estab-
lishing a merit and pension system for all employees of
the City, and providing for a referendum thereon.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be and it is hereby added to Article
23 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Wicomico County", sub-title "Salisbury", said
new section to be known as Section 293A, to follow immediate-
ly after Section 293 of said Article, and to read as follows:
293A. In addition to the other powers granted to the May-
or and Council of Salisbury in this Article, the Mayor and
Council of Salisbury shall have power to pass all by-laws and
ordinances not contrary to law, as it may deem necessary for
the good government of the city, to establish a merit and pen-
sion system for all employees of the City of Salisbury.
SEC. 2. And be it further enacted, That the provisions of
Section 293A of this Act shall not become effective until it has
been submitted to and ratified by the voters of Salisbury at
the municipal election to be held on May 12, 1939. On the
ballots to be used at the said election, there shall be printed
the word "For Merit and Pension System" and to the right
and opposite said words a square or box, and "Against Merit
and Pension System" and to the right and opposite said words
a square or box, so that each voter shall have the opportunity
to express his or her choice on said question. If a majority
of those voting on said question shall be "For Merit and Pen-
sion System", then Section 293A shall immediately become ef-
fective but if a majority of voters voting thereon shall be
"Against Merit and Pension System", then said section shall
be null and void and of no effect whatsoever.
SEC. 3. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and be-
ing passed upon a yea arid nay vote, supported by three-fifths
of all of the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.
