279. On the first Tuesday of May, 1939, and at the same
time every second year thereafter one person, a resident and
qualified voter of this City, not a member of the Council, shall
be elected by the registered voters as Clerk to the Council, Col-
lector of City Taxes and Treasurer who shall be the same per-
son and whose term of office shall be two years and until his
successor is duly elected and qualified. The said office shall
receive a salary of Eighteen Hundred Dollars per year;
and he shall perform all duties imposed on him by law or
ordinances of the City, and shall be called "Clerk of Salis-
bury. " His term shall begin on the first day of July after his
election. For the purpose of performing his duties as Col-
lector of City Taxes and Treasurer, the person appointed as
Clerk of Salisbury shall keep his office open for the transac-
tion of business from 8 o'clock in the morning until 5 o'clock
in the afternoon every week-day, except legal holidays, and for
the purpose of performing his duties as Clerk to the Council,
lie shall be on duty at such time or times as the Council shall
determine upon.

SEC. 2. And be it further enacted, That Section 267 of Arti-
cle 23 of the Code of Public Local Laws of Maryland (1930
Edition), title "Wicomico County", sub-title "Salisbury", be
and the same is hereby repealed.

SEC. 3. And be it further enacted, That the provisions of
Sections 266 and 279 of this Act shall not become effective
until it has been submitted to and ratified by the voters of
Salisbury at the municipal election to be held on May 12, 1939.
On the ballots to be used at the said election, there shall be
printed the words "For Charter Amendment" and to the right
and opposite said words a square or box, and "Against Char-
ter Amendment", and to the right and opposite said words a
square or box, so that each voter shall have the opportunity to
express his or her choice on said question. If a majority of
those voting on said question shall be "For Charter Amend-
ment", then Sections 266 and 279, and the other provisions
of this Act, Shall immediately become effective, but if a
majority of voters voting thereon shall be "Against Charter
Amendment", then said sections and other provisions of this
Act shall be null and void and of no effect whatsoever.

SEC. 4. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the im-
mediate preservation of the public health and safety, and be-
ing passed upon a yea and nay vote, supported by three-fifths
of all of the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date of
its passage.
