956G. The Council shall receive all election returns, and
within ten days after said election shall declare the result
thereof. They shall determine all questions arising thereon;
and any person conceiving himself aggrieved by reason of such
decision may appeal to the Circuit Court of Montgomery Coun-
ty, or to the Circuit Court of Prince George's County, depend-
ing upon the place of residence of the appellant, which shall
hear and determine the same, and determine who shall pay the
costs of appeal. In case of a tie at any election for Mayor and
members of the Council, another election shall be held, after ten
days' notice, pursuant to the provisions foregoing in regard to
elections. In case of any vacancy in the office of the Mayor
or Councilmen by death, resignation or removal from the town,
said vacancy shall be filled by a vote of the Council until the
next election for members of the Council.
957 (950). On the first Monday in April, 1940, and each two
years thereafter prior to the town election, the Boards of Elec-
tion Supervisors for Montgomery and Prince George's Coun-
ties, respectively, shall certify to the Mayor and Council alpha-
betical lists, for each precinct separately, of the names and
addresses of the registered voters in State and County Elec-
tions within the Fourth and the Sixth Precincts in Mont-
gomery County, within the town, within that portion of the
Ninth Precinct of the Thirteenth Election District in Mont-
gomery County within the Town, and within that portion of
the Fourth Precinct of the Chillum Election District in Prince
George's County within the town.
The said lists shall be certified in triplicate under the seal
of the Board of Election Supervisors of each County and shall
constitute the voters of the town. One copy of each list for
each precinct shall be posted for public inspection in the office
of the Town Clerk upon receipt of the same from the Boards
of Election Supervisors; one copy of each of said lists shall be
placed by the Clerk with the election returns and other re-
cords of the election to which the list relates; and a third copy
of each of said lists shall be supplied to the judges and clerks
of election for their, official guidance in conducting the election.
The respective Boards of Election Supervisors shall, on or
before the third Monday in April of each second year, begin-
ning in April, 1940, certify to the Mayor and Council, revisions,
if any, in the lists so certified theretofore by them, which may
be required to correct clerical mistakes in the preparation of
the original lists.
Names of persons added by such revisions shall be deemed
to have been certified originally and those persons shall be
entitled to vote in the next succeeding election; and names of
persons removed by such revisions shall be deemed not to have
been certified originally, and those persons shall not be en-
