gomery County", sub-title "Roads", said section to be known
as Section 754A, to follow immediately after Section 754 of
said Article and to provide for the establishment of rules,
regulations and orders respecting construction, maintenance,
grading and repairing of public highways in Montgomery
County, and to make any violation thereof a misdemeanor.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That a new section be, and it hereby is added to Article
16 of the Code of Public Local Laws of Maryland (1930 Edi-
tion), title "Montgomery County", sub-title "Roads", said new
section to be known as Section 754A, to follow immediately
after Section 754 of said Article and to read as follows:
754A. The Board of County Commissioners of Montgomery
County is hereby authorized, empowered and directed to adopt
and from time to time change and amend rules, regulations
and orders governing the proper construction, maintenance,
improvement, grading and repairing of the County roads,
lanes, streets, alleys, avenues, bridges, or other highways, in-
cluding those dedicated for public use but excepting those
located within special taxing areas and incorporated towns of
Montgomery County. Thereafter no public road, lane, street
alley, avenue, bridge, or other highway (excepting those located
in special taxing areas and incorporated towns) shall be con-
structed, repaired, graded, improved or maintained by any
person, association or corporation unless such construction,
repair, improvement, grading or maintenance complies in all
particulars with such rules, regulations or orders. Any per-
son, association or corporation violating any provision of
this Act or any rule, regulation, or order of the County Com-
missioners passed pursuant hereto shall be guilty of a mis-
demeanor punishable by a fine of not exceeding One Hundred
Dollars ($100. 00), or imprisonment for not more than thirty
(30) days, or both, for each offense, and each day's violation
shall constitute a separate offense.
SEC. 2. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
diate preservation of the public health and safety, and being
passed upon a yea and nay vote, supported by three-fifths of
all of the members of the two House of the General Assembly,
the same shall take effect from the date of its passage.
