closing of streets, lanes, and alleys of said town; and all benefits
received and all damages done by the said opening, closing,
widening, extending and improving of said streets or alleys,
shall be determined and assessed by three disinterested persons,
residents of said town, to be appointed by the said- commis-
sioners, or a majority thereof, who shall after a reasonable time
after notification of their appointment, take an oath before a
Justice of the Peace of Charles County, or a Notary Public of
said county, that they will faithfully, fairly and without par-
tiality or prejudice value and assess in money the loss and
damage to be suffered or incurred, as well as the benefits to be
received by any person or persons interested in the property
over, through or which the said street, lane or alley is to be
opened, closed, extended, widened or improved; and they shall
return the same in writing under their hands and seals with a
certificate of their qualifications before a justice of the peace or
notary public as hereinbefore provided, to the said commis-
sioners, which said valuation and assessment shall be ratified
or rejected by the said commissioners as in their judgment they
deem proper; and if any shall feel aggrieved by the deter-
mination of the said commissioners in ratifying or rejecting
said award or return, or in the amount of the compensation
awarded, benefits assessed or in any manner relating to the
same, he or they may appeal within thirty days of said ratifi-
cation to the Circuit Court for Charles County, and either
party may be entitled to a trial by a jury and the judgment of
said Court shall be final among the parties to such appeal.

175A. The said commissioners shall have power to pro-
vide, in any of their by-laws or ordinances, for a fine or
penalty not exceeding fifty dollars, to be imposed upon any
person for the violation thereof, and the said fine or penalty
may be recovered in the name of the corporation from the
person liable thereto before any justice of the peace for
Charles County like other debts; and provided further that if
the violation of the by-law or ordinance is criminal in its
nature, it shall be the duty of the bailiff or sheriff to arrest
the person so offending or violating the ordinance as afore-
said, and to take such person before some justice of the peace
for Charles County, and upon conviction for such offense the
said offender shall be fined not less than one dollar nor more
than fifty dollars, and costs, such fine to go to the use of said
corporation, and in default of payment of said fine and costs
as aforesaid, the person so1 convicted shall be committed to
